Welcome to AssistlyGo (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, platform, and services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use our Services. By using AssistlyGo, you represent and warrant that you meet these eligibility requirements.

2. Our Services

AssistlyGo connects businesses (“Clients”) with qualified virtual assistants and service providers (“Freelancers”). Services include, but are not limited to, administrative support, customer service, data entry, content creation, and other business-related tasks. 3. Use of the Services

To access certain features or services, users may need to engage with us directly or through the platform. You agree to:

  • Provide accurate and complete information when engaging with our services.
  • Use the Services in compliance with these Terms.

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. User Responsibilities

Clients and Freelancers are responsible for their own conduct and the information they submit.

You agree not to:

  • Violate any laws or regulations.
  • Infringe upon intellectual property rights.
  • Harass, threaten, or defraud other users.
  • Transmit viruses or malicious code.

5. Payment Terms and Charges

a. Pricing
AssistlyGo offers tiered subscription plans and custom service packages based on business needs. Specific pricing is listed on our website, or you may receive a custom quote based on your requirements. All pricing is in U.S. dollars (USD).

b. Payment Processing
Payments are processed through third-party providers. By using our services, you authorize us to charge your payment method for:

  • Subscription fees (billed monthly or annually).
  • Hourly or fixed project-based service fees.
  • Add-on or custom service fees agreed upon via contract.

c. Billing Cycles
Subscriptions auto-renew unless canceled before the billing date.
Invoices for fixed-price services are due within 7 days unless otherwise agreed.

d. Payment Details
You will be provided with a link to enter your payment details along with a Master Service Agreement. By submitting your payment details, you agree to be charged automatically according to your selected subscription plan or service agreement.

e. Late Payments
Late payments may incur:

  • Interest at 1.5% per month or the maximum allowed by law.
  • Suspension of services.
  • Collection and legal fees if applicable.

f. Refunds
Refunds for subscription cancellations are available only within the first 7 days of service unless otherwise specified in a separate written agreement.

6. Freelancer and Virtual Assistant Engagement and Independent Contractor Status

Freelancers and Virtual Assistants engaged through AssistlyGo are independent contractors and not employees of AssistlyGo. While we carefully vet all freelancers and Virtual Assistants for relevant experience and professionalism, they retain full discretion over how they perform their services. Clients are encouraged to communicate clearly with freelancers and Virtual Assistants to ensure alignment on expectations and are ultimately responsible for managing the outcome and satisfaction of their projects.

7. Intellectual Property

All content on our platform (excluding user submissions) is owned by AssistlyGo or its licensors.
You may not copy, modify, or distribute this content without permission.

Clients retain ownership of submitted materials and deliverables created by freelancers unless otherwise agreed. Freelancers grant AssistlyGo a limited license to use their submitted profiles and portfolios for marketing and operational purposes.

8. Dispute Resolution

We encourage users to resolve disputes directly. If resolution is not possible, please contact us at [email protected]. We may offer mediation but are not liable for disputes between users.

For unresolved disputes, formal mediation or arbitration may be pursued as per the laws of Delaware.

9. Termination

You may cancel your account at any time. We may suspend or terminate your access for:

  • Breach of these Terms.
  • Illegal activities.
  • Fraudulent or abusive behavior.

10. Limitation of Liability

To the maximum extent permitted by law, AssistlyGo is not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.

11. Disclaimer of Warranties

The Services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free services.

12. Indemnification

You agree to indemnify and hold harmless AssistlyGo, its affiliates, and employees from any claims, damages, or legal fees arising from your use of the Services or your violation of these Terms.

13. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which can be found at Privacy Policy. Please review it to understand how we collect, use, and protect your data.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through our platform. Continued use of the Services constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
